The Journal of Commerce has reported that “[t]he container shipping industry is marshalling a response to signs of a building import backlog as some retailers and manufacturers fail to pick up containers because warehouses are full or closed due to not being deemed essential service providers responding to the coronavirus disease 2019 (COVID-19).” Whether it’s machinery packed in containers, or a Cape Size waiting to load thousands of tons of ore, reduced port and logistics efficiencies and international border closures have affected all stakeholders in the supply chain.
Demurrage and detention charges can seriously impact forecasted profits, and the ongoing challenges to transport efficiency means that these will only become more common. The issues of how to avoid unexpected claims, or who is liable for these charges, and under what conditions they might not be liable, are well worn issues, but bear a closer look as pressure in the system builds.
